1. Introduction

Welcome to Nexum Digital. By accessing or using this website (https://nexumdigital.ie/) or working with us, you agree to these Terms & Conditions. If you do not agree, please do not use our website or services.

“Nexum Digital”, “we”, “our”, and “us” refer to the service provider. “You” refers to users, visitors, and clients.

2. Services

Nexum Digital provides:

  • Website development
  • Brand identity & design
  • Digital strategy
  • Marketing and content services

Details of services, deliverables, and timelines will be outlined in individual project proposals or agreements.

3. Quotes & Proposals

All quotes are valid for 30 days unless otherwise stated.
A project begins only after written acceptance and initial payment/deposit.

4. Payments & Billing

Unless otherwise agreed:

  • A deposit is required to begin work
  • Remaining payments are due upon delivery or according to project milestones
  • Monthly plans renew automatically unless cancelled
  • Late payments may delay project timelines

Prices are displayed in Euro (€) and may be subject to VAT where applicable.

5. Project Timelines

We aim to complete work within the timelines agreed in your proposal.
Delays caused by late content, approvals, or feedback from the client may extend the project schedule.

6. Revisions

Each project includes revisions as described in your proposal.
Additional revisions or changes outside the agreed scope may incur additional costs.

7. Client Responsibilities

Clients must provide:

  • Accurate information
  • Timely feedback
  • Content, images, and materials (unless agreed otherwise)

By sending content to Nexum Digital, you confirm that you own the rights or have permission to use it.

8. Intellectual Property

Upon full payment:

  • You own the final website and brand assets created for you
  • Nexum Digital retains ownership of working files, concepts, drafts, and proprietary methodologies
  • We may display completed projects in our portfolio unless agreed otherwise

Any third-party assets (fonts, stock images, plugins) are subject to their individual licenses.

9. Website Hosting & Maintenance

Unless included in your plan:

  • Hosting, domain registration, and maintenance are the responsibility of the client
  • Nexum Digital is not liable for outages or losses caused by third-party providers

Optional maintenance and support packages are available.

10. Liability

Nexum Digital is not liable for:

  • Loss of profits, revenue, or data
  • Business interruption
  • Issues caused by third-party services, plugins, or hosting
  • Website misuse or unauthorised access

We provide services on a “best effort” basis but do not guarantee specific rankings or outcomes.

11. Website Performance & SEO

We follow best practices for website performance and SEO; however:

  • Rankings cannot be guaranteed
  • SEO impact depends on content, competition, and external factors
  • Continued SEO requires maintenance beyond launch

12. Cancellations & Termination

Either party may cancel a project with written notice.
Completed work up to that date must be paid for in full.
Monthly plans may be cancelled anytime prior to the next billing cycle.

13. Data Protection

We comply with GDPR.

14. Governing Law

These Terms & Conditions are governed by the laws of Ireland.
Any disputes shall be resolved under Irish jurisdiction.
